Frequently Asked Questions

What is a Notary Public?

A Notary Public is an official of integrity appointed by the state government — typically by the secretary of state — to serve the public as an impartial witness in performing a variety of official fraud-deterrent acts related to the signing of important documents. These official acts are called notarizations, or notarial acts. Notaries are publicly commissioned as "ministerial" officials, meaning that they are expected to follow written rules without the exercise of significant personal discretion, as would otherwise be the case with a "judicial" official.

May a Notary notarize a document without the person being present?

No.  A Notary Public may only perform notarial acts by requiring a personal appearance. The document signer must always appear before the Notary for the notarization.

What is a signing agent?

A signing agent is a certified Notary who has been trained to handle the proper signing of loan documents. Lenders and title companies hire signing agents as independent contractors to assist in the last step of the loan process.

Are you bonded and has your background been checked?

Yes, we’re bonded and have undergone background screenings. All notaries are also required to be bonded in order to protect the public from negligent mistakes or dishonest acts performed by the notary.
